Service terms.
What you get, what we promise, what we do not, and the limits each side accepts. Written to be read, not to be hidden behind. Reading time about ten minutes.
- 1. The service
- afair is a persistent memory layer for AI tools. Subscribers receive one dedicated machine in the EU running the open-source afair stack, accessible through the Model Context Protocol (MCP) from any compatible tool (Claude Code, Cursor, ChatGPT, Codex, and others). The service stores user-supplied text, audio, and binary content, processes it with third-party language models for extraction and search, and exposes the result through three frozen MCP verbs: remember, recall, observe. Provisioning currently runs in the Frankfurt region; additional EU regions are planned as volume warrants.
- 2. Subscription, billing, cancellation
- The subscription costs €10 per calendar month, charged in advance via Stripe at the start of each billing cycle. Cancellation is available at any time through the Stripe customer portal; the machine continues to run until the end of the paid period, then is paused and destroyed thirty days after cancellation takes effect. No partial refunds for early cancellation. VAT is added where legally required. Prices are subject to thirty days written notice before any change takes effect; the user may cancel during the notice period to avoid the new price.
- 3. Account ownership and content
- You own everything you put into your vault. afair takes no copyright, no license to your content beyond what is technically necessary to deliver the service (running the extractors, serving recall queries, performing backups, replying to your own MCP calls). The service code is licensed under the GNU Affero General Public License v3, published at github.com/afair-ai. You may self-host the entire stack at any time. Subscribing to the managed service is convenience, not lock-in.
- 4. Acceptable use
- No content that violates German or EU law. No use of the service to generate or distribute material depicting child sexual abuse, terrorist material, malicious code, or content infringing third-party intellectual property where the user knows or should know it is infringing. No spam outbound through the integrations. No attempt to extract another tenant's data (each machine is single-tenant by design; the architecture makes cross-tenant access infeasible, but probing for it ends the account). Violations result in immediate termination with refund of the unused portion of the current month.
- 5. Service availability and SLA
- Best-effort 99.5 percent monthly uptime, measured at the MCP endpoint. The service runs on Fly.io and inherits Fly's regional-availability characteristics; planned maintenance windows are announced at status.afair.ai with at least seventy-two hours notice. No formal SLA credits in the early-access phase (months 1–6 after launch); after that an SLA addendum will be published with credit rules.
- 6. Data export and deletion
- Full vault export is available at any time as JSON Lines via the export endpoint. Cancellation triggers destruction of the live vault within thirty days, plus removal from all backup snapshots within ninety days. Deletion requests under GDPR Art. 17 are honored independently of cancellation, on the same timeline. See /datenschutz for the full data-handling description.
- 7. EU AI Act transparency (Reg. 2024/1689 Art. 50)
- The service uses third-party AI models from Anthropic, OpenAI, and Google to process user content into structured form (extractions, embeddings, entity graph, salience scores). Under the EU AI Act this counts as deployment of an AI system with limited-risk transparency obligations. The service does not deploy any high-risk system under Annex III: no use in employment, education, law enforcement, biometric identification, critical infrastructure, essential services, migration, justice, or democratic processes. The service does not perform automated decision-making about subscribers; all output is informational and the subscriber chooses whether to act on it. Foundation models used by the service are operated by upstream providers and remain their responsibility under the AI Act's general-purpose AI obligations.

Liability
- afair is provided as-is. To the extent permitted by German law, liability is limited to the subscription fees paid in the twelve months preceding the event. Limitation does not apply to intent, gross negligence, injury to life or body, or claims under the Produkthaftungsgesetz. The service is not a backup of your AI conversations; you remain responsible for keeping copies of anything you cannot afford to lose.
- 9. Right of withdrawal (Widerrufsrecht)
- Consumers in the EU have a fourteen-day right of withdrawal from the start of the subscription. To exercise, write to hello@afair.ai with the words "I withdraw from my afair subscription" within fourteen days of first payment; the full month is refunded and the machine is destroyed within thirty days. The right is lost when the user actively uses the service after subscription start (write of the first event); this is disclosed at checkout per § 312f BGB and § 356 BGB.
- 10. Changes to these terms
- We will give at least thirty days written notice before any non-trivial change takes effect. Notice goes to the email associated with the subscription. The user may cancel during the notice period and receive a pro-rated refund for the unused portion. Continued use after the notice period counts as acceptance.
- 11. Governing law and jurisdiction
- These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Berlin. Consumer rights under the law of the consumer's habitual residence remain unaffected. The user may also bring proceedings before the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
